New Bankruptcy LawThe new bankruptcy law went into effect in October 2005. The new law requires those interested in filing bankruptcy to participate in credit counseling. The individual will need to go through credit counseling before filing, by an agency approved by the United States Trustee's office. After the bankruptcy case has settled, the individual will need to participate in an additional credit counseling class. Individuals will also undergo a means test, comparing them to the median income of the state in which they live. This means test will determine a person's eligibility for filing Chapter 7 Bankruptcy.
